Yes, but no one does because the entire rest of the world would look down on them for suing a non-profit organization. Most that would happen would be a C&D, but I doubt even that will come.

i figure they would go after the private server emulators WAY before they go after O.K. .. Are those open source? I mean aren't they dealing with copyright issues?

My title was kind of facetious. OpenKore is safe, even under this ruling.

However, the ruling paints a bleek outlook for the future of legitimate for-profit program creation that sets out to do what OpenKore or Glider did.

Except that OpenKore and Glider work in completely different ways. XKore 1 is closer to Glider in the sense that it works with the client's memory. But other than that, they're apples and oranges.
